Personal Information You Disclose To Us
We collect personal information that you voluntarily provide to us when you express an interest in obtaining information about us or our products and Services, when you participate in activities on the Services, or otherwise when you contact us. The personal information we collect may include the following:
- Names
- Phone Numbers
- Email Addresses
- Organization or team details you provide through our interest form, such as organization or team name, sport, and roster size
- Your SMS/MMS opt-in preference and related consent records, if you choose to opt in to text messaging (the mobile number you opted in with, the date and method of your opt-in, and the version of the SMS terms you agreed to)
We do not collect sensitive personal data.
Information From Publicly Available Sources
For business-to-business sales and outreach, our sales representatives may collect business or organizational contact information from publicly available sources, including:
- Organization or business websites
- Public directories
- Business or organizational social-media pages
- Publicly available records
- Referrals
This information may include a person's name, role or title, organization, publicly listed telephone number, publicly listed email address, and other publicly available business contact information. We use it to contact organizations about our custom uniform and apparel services, for example by phone or email.
Obtaining a person's contact information from a publicly available source does not, by itself, constitute that person's consent to receive SMS or MMS messages from us. We do not send SMS/MMS messages to a mobile number obtained from a public source unless the person has opted in to receive them, as described in the section "SMS COMMUNICATIONS AND MOBILE INFORMATION" below.
Information Automatically Collected
We automatically collect certain information when you visit, use, or navigate the Services. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our Services, and other technical information. This information is primarily needed to maintain the security and operation of our Services, and for our internal analytics and reporting purposes.
2. How Do We Process Your Information?
We process your personal information for a variety of reasons, depending on how you interact with our Services, including:
- To deliver and facilitate delivery of services to the user. We may process your information to provide you with the requested service.
- To respond to user inquiries/offer support to users. We may process your information to respond to your inquiries and solve any potential issues you might have with the requested service.
- To send you text messages you have opted in to receive. If you opt in to SMS/MMS messaging, we may use your mobile number to send messages within the scope of your consent, as described in the section "SMS COMMUNICATIONS AND MOBILE INFORMATION" below.
- To fulfill and manage your orders. We may process your information to fulfill and manage your orders, payments, returns, and exchanges made through the Services.
- To request feedback. We may process your information when necessary to request feedback and to contact you about your use of our Services.
- To evaluate and improve our Services, products, marketing, and your experience. We may process your information when we believe it is necessary to identify usage trends, determine the effectiveness of our promotional campaigns, and to evaluate and improve our Services, products, marketing, and your experience.

3. When and With Whom do we Share Your Personal Information?
Vendors, Consultants, and Other Third-Party Service Providers. We may share your data with third-party vendors, service providers, contractors, or agents ("third parties") who perform services for us or on our behalf and require access to such information to do that work. We have contracts in place with our third parties, which are designed to help safeguard your personal information. This means that they cannot do anything with your personal information unless we have instructed them to do it. They will also not share your personal information with any organization apart from us. They also commit to protect the data they hold on our behalf and to retain it for the period we instruct.

- Business Partners. We may share your information with our business partners to offer you certain products, services, or promotions. This does not include mobile information or SMS opt-in consent.
Mobile Information and SMS Opt-In Consent. Mobile information and SMS opt-in consent will not be shared with or sold to third parties or affiliates for marketing or promotional purposes. Information sharing with subcontractors in support services, such as customer service, is permitted. This restriction applies regardless of the categories and situations described above: none of the vendor categories listed (including Ad Networks, Data Analytics Services, and Sales & Marketing Tools) and none of the Business Transfers, Affiliates, or Business Partners provisions authorize sharing or selling mobile information or SMS opt-in consent with third parties or affiliates for their marketing or promotional purposes. See the section "SMS COMMUNICATIONS AND MOBILE INFORMATION" below.
4. SMS Communications and Mobile Information
We offer SMS and MMS text messaging to customers and prospective customers who affirmatively opt in, either by checking the optional SMS consent checkbox on our interest form (it is unchecked by default) or by giving your consent directly to a Versus Sportswear representative, for example during a phone call. Providing your phone number on our interest form is not, by itself, an opt-in. Opting in is not required to submit our interest form, and consent to receive text messages is not a condition of purchasing any goods or services from us.
When you opt in, we record your consent in our customer relationship management system, including the mobile number you opted in with, the date and method of your opt-in, and the version of the SMS terms in effect at that time, so we can honor your preferences and document your consent. If you opt out, we record that too.
If you opt in, we may use the mobile telephone number you provide to send messages within the scope of your consent, such as:
- Communications about your inquiry
- Quotes
- Custom mockups
- Product information
- Sizing or roster information
- Order and service updates
- Customer support
- Information you have requested
Message frequency varies based on your inquiry, order, and interactions with us. Message and data rates may apply. You can opt out at any time by replying STOP to any message from us; after you opt out, you may receive one final confirmation message and will not receive further text messages from us unless you opt in again. How We Share Mobile Information
Mobile information and SMS opt-in consent will not be shared with or sold to third parties or affiliates for marketing or promotional purposes. Information sharing with subcontractors in support services, such as customer service, is permitted.
For example, we may disclose mobile telephone information to subcontractors and service providers that help us provide customer service, communications, or messaging services (such as our customer relationship management and text-messaging providers), but only as necessary for them to provide those services on our behalf and subject to the contractual protections described in the section "WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?" above. The restriction on marketing and promotional sharing applies regardless of any other data-sharing provision in this Privacy Notice.
5. Do We Use Cookies and Other Tracking Technologies?
We may use cookies and similar tracking technologies (like web beacons and pixels) to gather information when you interact with our Services. Some online tracking technologies help us maintain the security of our Services, prevent crashes, fix bugs, save your preferences, and assist with basic site functions.
We also permit third parties and service providers to use online tracking technologies on our Services for analytics and advertising. The third parties and service providers use their technology to provide advertising about products and services tailored to your interests which may appear either on our Services or on other websites.

6. How Long Do We Keep Your Information?

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security of any personal information we process. 8. Do We Collect Information From Minors?
We do not knowingly collect, solicit data from, or market to children under 18 years of age, nor do we knowingly sell such personal information. By using the Services, you represent that you are at least 18 or that you are the parent or guardian of such a minor and consent to such minor dependent's use of the Services. If we learn that personal information from users less than 18 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records. If you have opted in to receive text messages from us, you can also withdraw that consent at any time by replying STOP to any message.
However, please note that this will not affect the lawfulness of the processing before its withdrawal nor, when applicable law allows, will it affect the processing of your personal information conducted in reliance on lawful processing grounds other than consent.

10. Controls For Do-Not-Track Features
We do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online due to lack of an industry standard. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Notice.
11. Do United States Residents Have Specific Privacy Rights?
Residents of certain states (including California, Colorado, Connecticut, Florida, Texas, and others) may have additional rights regarding access, deletion, and correction of personal information, as well as the right to opt out of targeted advertising or the sale/share of personal data.

Request Verification
Upon receiving your request, we will need to verify your identity to determine you are the same person about whom we have the information in our system. Appeals

California "Shine The Light" Law
California Civil Code Section 1798.83, also known as the "Shine The Light" law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year.
