1. Accepting These Terms

When you visit or use our Site, you accept and agree to these Terms. If you don’t agree, please do not use the Site. We may update these Terms from time to time; the “Last updated” date above will change when we do. Continued use means you accept those updates.

2. Our Services

Our Site is informational only. You can:

• Learn about our custom sports uniform and spirit wear services.
• View galleries, pricing ranges, and process overviews.
• Fill out an interest form to start an order.

3. Interest Form and Communication

When you submit our interest form, you provide:

• Whether you're a team or organization
• Your team name, sports, and roster size
• Contact info (name, email, phone)

We use this data solely to respond to your inquiry and guide you through mockups, ordering, and fulfillment. When you submit the form, a Versus Sportswear representative may follow up with you by phone or email about your inquiry. If you'd rather not receive follow-up communications, let us know at [email protected].

Submitting the interest form does not, by itself, sign you up for text messages, and providing your phone number on the form is not, by itself, consent to receive them. The form includes a separate, optional SMS consent checkbox that is unchecked by default; you can leave it unchecked and still submit the form. We send SMS and MMS messages only if you separately opt in, and those messages are governed by the SMS Terms & Conditions below.

4. SMS Terms & Conditions

These SMS Terms & Conditions govern the SMS and MMS text messaging program operated by Versus Sportswear LLC (doing business as “Versus Sportswear”; “we,” “us,” or “our”). Participation is limited to customers and prospective customers who affirmatively opt in as described below.

Program Description

Versus Sportswear uses SMS and MMS messaging for customer-care communications with people who have opted in, including service follow-up, responses to customer inquiries, quotes, custom mockups, product inquiries and product information, sizing or roster information, orders, and delivery and order updates, as well as links or information you have requested from us.

Your opt-in covers these inquiry and customer-care messages. It does not sign you up for unrelated promotional or marketing text messages; any such messages would require a separate, specific opt-in.

Opting In

SMS consent is optional. You can opt in by checking the optional SMS consent checkbox on our website interest form (it is unchecked by default), or by giving your consent directly to a Versus Sportswear representative, for example during a phone call, which we document in our records. Opting in is not required to submit the interest form, and consent to receive SMS/MMS messages is not a condition of purchasing any goods or services from us. Providing your phone number alone, on the interest form or otherwise, does not constitute consent to receive text messages.

Message Frequency

Message frequency varies based on your inquiry, order, and interactions with us.

Pricing

Message and data rates may apply depending on your mobile plan. Contact your wireless carrier for details.

Opt-Out

You may reply STOP to any message from us at any time. After you reply STOP, you may receive one final message confirming that you have been unsubscribed, and no further SMS/MMS messages will be sent to you unless you opt in again. If you later want to receive messages again, you can re-enroll by checking the SMS consent checkbox on a new interest-form submission or by giving your consent to a Versus Sportswear representative.

Carrier Liability

Mobile carriers are not liable for delayed or undelivered messages.

Privacy

Mobile information and SMS opt-in consent will not be shared with or sold to third parties or affiliates for marketing or promotional purposes. Information sharing with subcontractors in support services, such as customer service, is permitted. Your participation in our SMS program is also subject to our Privacy Policy, which explains how we collect, use, and protect your mobile information and SMS opt-in consent.

5. Offline Order Process

• Consultation: We'll discuss products, quantities, pricing, and timelines.
• Mockups: Our art team creates design proofs based on your feedback.
• Approval: Once you sign off on mockups, we set up your ordering store on Inksoft.
• Ordering & Payment: You place a final order, we send an invoice, and you pay in full before production.
• Production & Delivery: We produce your items and arrange shipment or pickup

Because much of this occurs off-Site, these Terms cover only your use of our Site and interest form and, if you opt in, our SMS program.

6. Intellectual Property

All Site content—text, graphics, logos, templates, and software—is owned or licensed by Versus Sportswear and is protected by copyright, trademark, and other laws. You may view and print pages for your own non-commercial use only. Any other use (republishing, selling, modifying) requires our written permission.

7. Disclaimers and Limitations

• "AS-IS" Basis: The Site is provided "as-is" and “as-available.” We don't promise it's error-free or uninterrupted.
• No Professional Advice: Content is for general information. Always confirm details with us directly.
• Limitation of Liability: To the fullest extent allowed by law, we're not liable for any damages arising from your use of the Site or reliance on its content.

8. Privacy

9. Changes to Our Site or Terms

We may modify or discontinue the Site (or features) at any time without notice. We may also change these Terms; your continued use means you accept those changes.

10. Governing Law

These Terms are governed by Texas law. Any dispute arising under these Terms will be resolved in the state or federal courts located in Johnson County, Texas.
